Privacy Policy
I. Basic Provisions
- The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "GDPR") is eN Services s.r.o. - Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
- The controller has not appointed a data protection officer.
II. Sources and Categories of Processed Personal Data
- The controller processes personal data that you have provided or personal data obtained by the controller in connection with the fulfillment of your order.
- The controller processes your identification and contact data and any data necessary for the performance of the contract.
III. Legal Grounds and Purpose of Personal Data Processing
- The legal grounds for the processing of personal data are:
- the performance of a contract between you and the controller pursuant to Article 6(1)(b) GDPR,
- the legitimate interest of the controller in providing direct marketing (especially for sending commercial messages and newsletters) pursuant to Article 6(1)(f) GDPR,
- your consent to processing for the purpose of direct marketing (especially for sending commercial messages and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in the event that no order for goods or services has been placed.
- The purpose of personal data processing is:
- to process your order and exercise the rights and obligations arising from the contractual relationship between you and the controller; personal data necessary for successful order fulfillment (such as name, address, contact) are required when placing an order—providing personal data is a necessary requirement for concluding and fulfilling the contract; without providing personal data, it is not possible to conclude or fulfill the contract on the part of the controller,
- to send commercial messages and conduct other marketing activities.
- The controller does not carry out automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent to such processing.
IV. Data Retention Period
- The controller stores personal data:
- for the time necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims arising from these contractual relationships (for a period of 15 years from the end of the contractual relationship),
- until consent to the processing of personal data for marketing purposes is withdrawn, but no longer than 15 years, if the processing is based on consent.
- After the expiration of the data retention period, the controller will delete the personal data.
V. Recipients of Personal Data (Controller’s Subcontractors)
- The recipients of personal data are:
- persons involved in the delivery of goods / services / payment processing under the contract,
- providers of e-shop operation services (e.g., Shoptet) and other related services,
- marketing service providers.
- The controller does not intend to transfer personal data to a third country (outside the EU) or an international organization.
VI. Your Rights
- Under the conditions set out in the GDPR, you have the:
- right to access your personal data under Article 15 GDPR,
- right to rectification of personal data under Article 16 GDPR, or restriction of processing under Article 18 GDPR,
- right to erasure of personal data under Article 17 GDPR,
- right to object to processing under Article 21 GDPR,
- right to data portability under Article 20 GDPR,
- right to withdraw consent to processing in writing or electronically to the controller’s address or email specified in Article I of this policy.
- You also have the right to lodge a complaint with the Data Protection Authority if you believe that your right to the protection of personal data has been violated.
VII. Personal Data Security Conditions
- The controller declares that all appropriate technical and organizational measures have been taken to secure personal data.
- The controller has taken technical measures to secure data storage by the e-shop operator (Shoptet).
- The controller declares that access to personal data is granted only to persons authorized by the controller.
VIII. Final Provisions
- By submitting an order via the online order form, you confirm that you have read and fully accept the privacy policy.
- You agree to this policy by ticking the consent checkbox in the online form. By doing so, you confirm that you have read and fully accept the privacy policy.
- The controller is entitled to change thus privacy policy. A new version of the privacy policy will be published on the controller’s website and will also be sent to your email address provided to the controller.
This privacy policy shall take effect as of 9 April 2025.
